The city of New York will be paying $4 million from a $5.9 million wrongful death settlement to the family of Eric Garner, according to lawyers involved in the case.
Esaw Snipes, Garner’s widow, will receive $1.4 million and his 3-year-old daughter Legacy Jayleen Garner Miller, his youngest child, will receive $1.3 million.
“I’m very happy that Legacy is going to be getting an increase in funds from what was originally proposed,” said attorney Lorraine Coyle, who represents Garner-Miller. According to Coyle the original amount was less than $1 million.
Garner’s other children will also get a portion of the settlement with his daughters Erica and Emerald Snipes receiving $163,000 each, their older brother, Eric, getting $204,000 and their youngest brother Emery, who is still a minor, receiving $482,000. Garner’s mother Gwen Carr ,who is managing her son’s estate, will receive $82,000.
The money will be paid out over 90 days in annuities and annual installments, Coyle told the New York Post.
Attorney’s fee are yet to determined, according to Coyle, who says that lawyers are usually paired one-third of the settlement, but there was little legal work done due to the city settling before the family filed a lawsuit.
Though the law firm of Rubenstein and Rynecki and civil rights attorney Jonathan Moore are eligible for $2 million in legal fees, both Scott Rynecki and Moore have said they are not asking for a specific amount and will leave that decision to the judge.
