Appeals court blocks Wisconsin emergency order limiting capacity in restaurants, bars

A Wisconsin court of appeals has reversed a lower court’s ruling and put a temporary stop to an emergency health order from Gov. Tony Evers’ administration to limit gatherings and business capacities.

Emergency Order #3 is no longer in force, which limits the number of people that can be in bars and restaurants to 25% capacity due to the COVID-19 pandemic. It was set to expire on Friday.

The Department of Health Services issued the order in early October, sparking a lawsuit from the Tavern League of Wisconsin.

Evers’ administration can appeal the ruling to the Wisconsin Supreme Court.
